Reference: Public disclosure on 07/24/2020. Our July 24th, 2020 announcement on the Public Disclosure Platform explained that a group of plaintiffs filed a lawsuit against Halkbank to satisfy their judgements in the United States. United States District Court for the Southern District of New York conditionally dismissed the case on February 16th, 2021 by granting Halkbank's objection on grounds of forum non conveniens. As to the possibility of litigation in Turkey, the Court ordered the parties to come to an agreement concerning their objections around the bringing of a lawsuit and file the same to the Court by March 2nd, 2021. In the criminal case at the US District Court for the Southern District of New York, the Bank's Foreign Sovereign Immunities Act ("FSIA") appeal is currently pending review by the United States Court of Appeals for the Second Circuit.
